What is Prop 65?
California Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act, is a law enacted in 1986 in California that requires businesses to provide warnings to consumers about the presence of certain chemicals in products they sell or expose them to, that are known to cause cancer, birth defects, or other reproductive harm.
Prop 65 is aimed at protecting California residents from exposure to toxic chemicals in the environment, and the warning requirement applies to a wide range of products, including food, beverages, consumer products, and building materials.
Businesses that violate Prop 65 can face significant penalties and lawsuits from the state or private citizens. To comply with the law, businesses must evaluate their products for the presence of listed chemicals, and if they are present, provide a clear and reasonable warning to consumers.
Why do we include this warning?
Our company has chosen to provide consumers with as much information as possible so that they can make informed decisions about the products they buy and use. We provide warnings based on our knowledge of the presence of one or more listed chemicals. While the exposure from our products may be negligible or well within the “no significant risk” range, out of an abundance of caution, we have elected to provide the Prop 65 warnings. Moreover, if we do not provide these warnings, we could be sued by the State of California or by private parties seeking to enforce Prop 65 and subject to substantial penalties.
